Article of Interest: Proving Negligence can be Tricky

The following story was based off of an article found in the June 2010 edition of Trial magazine:

While trying to avoid hitting a smoke bomb that had rolled into the road, the driver of a minivan swerved and struck a motorcycle. Both the driver and passenger were thrown from the bike, resulting in critical injuries and hefty future medical expenses for both.

The smoke bomb was lit by two minors who were setting off fireworks in a driveway. Evidence showed that, during the incident, the parents of one of the minors were in the backyard.

The motorcyclists brought suit, arguing that the minors were negligent in setting off the smoke bomb on an inclined driveway and that the minivan driver was negligent in swerving into oncoming traffic. However, the driver of the minivan argued that she was reacting to an emergency situation.

Just from reading a snipet of the facts presented in this article, you can begin to assume that accidents can happen at anytime and involve many people. In a case like this, it may be tricky to pinpoint exactly who is responsible for the accident, let alone any injuries that were sustained.
